Share To Care Terms
The extra terms that apply when you create, run and share a Care Page with Share To Care.
These terms apply when you create a Care Page with Share To Care. They add to our Terms & Conditions, which apply to everyone who uses Legacy. If the two conflict on anything to do with your Care Page, these terms win. Our Privacy Policy explains how we use personal data, including yours and your supporters’.
Share To Care is run by Stewards Of Tomorrow Ltd (“Legacy”, “we”, “us”), a non-profit company limited by guarantee, registered in England and Wales (company number 15589404). Registered office: C/O West & Berry Limited, Nile House, Nile Street, Brighton, BN1 1HW, United Kingdom.
What Share To Care is
A Care Page is a public page that shows the charities you back, why they matter to you, and what your community has given to them. You build and manage it in the creator studio at my.givewithlegacy.com, and it is published at care.givewithlegacy.com followed by your page address.
People who give through your page (“supporters”) pay us, Stripe processes the payment, and we make a matching payment to Charities Trust (registered charity 327489) for the causes the supporter chose. Our Terms & Conditions explain how donations, costs, tips and Gift Aid work.
Share To Care is free for creators. You pay nothing to create or run a Care Page, and you receive nothing from the gifts made through it. Your page tells supporters this.
Who can create a Care Page
You can create a Care Page if:
- you are 18 or over;
- you live in the UK;
- you have a Legacy account in your own name; and
- we have not previously removed a Care Page or account of yours, unless we have agreed otherwise.
Each account can have one Care Page. You can create it for a brand, group or organisation you are part of if you are authorised to act for it. If you do, these terms bind it as well as you.
We check your page before it goes live
We review every Care Page before it goes public, usually within a couple of days. We review it again whenever you change your name, photo, bio, causes or reasons. Changes to your theme and display settings go live straight away.
We may decline a page or a change. If we do, we will tell you why in the creator studio. Our review checks your page against these terms. It is not an endorsement of you or of anything you say.
Your page address
You choose your page address when you first send your page for review. It can be 3 to 30 lowercase letters, numbers and hyphens, and some words are reserved. Once claimed, it is yours for as long as your page exists and you cannot change it.
We may remove or reassign a page address if it breaks these terms, for example if it impersonates someone, uses a name or brand you do not have permission to use, or is offensive.
What goes on your page
You are responsible for everything you add to your Care Page, including your name, photo, bio, links and the reasons you give for each cause (“your content”).
Your content must:
- be honest and accurate, and give your own views and experiences;
- make clear that you are supporting the charities in aid of them, as an individual or as the organisation you represent, and not on their behalf;
- be yours to use, meaning you own or have permission to use any photo, name, logo or words you add;
- only show other people if they have agreed to it, and only show a child with the permission of their parent or guardian; and
- follow the law and the rules in Keeping Legacy safe.
Your content must not:
- say or suggest that a charity, Legacy or anyone else endorses, sponsors or works with you, unless they do and have agreed that you can say so;
- promise how a charity will spend donations, or say that gifts will fund a particular project, unless the charity has confirmed it;
- pressure people to give, use guilt or shame, or target people who may be in vulnerable circumstances;
- impersonate anyone, or mislead people about who you are;
- include anyone’s personal information without their permission; or
- advertise or sell anything.
Fundraising rules
When you share your Care Page, you are fundraising in aid of the charities on it. The Code of Fundraising Practice sets the standards for fundraising in the UK. As a condition of using Share To Care, you agree to follow the parts of the Code that apply to you as an individual fundraiser. Before you share your page, please read the Fundraising Regulator’s advice for people setting up an online fundraising appeal.
In particular:
- Only ask people to give through your Care Page. Do not collect money for the causes yourself, in cash, by bank transfer or any other way, and say it is for your Care Page.
- Do not offer anything in return for a gift, such as a prize draw, raffle, competition, merchandise or discount. Prize draws and raffles are regulated by gambling law, benefits given in return for a gift can stop Gift Aid being claimed on it, and linking gifts to the sale of goods or services can make you a “commercial participator” with legal duties of your own.
- Do not say that you, or anyone else, will match or add to gifts unless it is true.
- Only share your page in ways the law allows. Do not send spam or unsolicited messages, and do not buy followers, clicks or other fake engagement.
- If anyone pays you, or gives you anything, to promote your Care Page or Legacy, label those posts as advertising, following the advertising rules and the Advertising Standards Authority’s and Competition and Markets Authority’s guidance for influencers.
Your supporters
Supporters choose whether their name appears on your page. It only shows if they switch on “Show my name”, and then as their first name and surname initial.
In the creator studio you can see what your page has raised, how many people have supported it and how many times it has been viewed. You can also see recent gifts, with their amount, cause and time, whether it is the supporter’s first gift through your page, and the supporter’s name if they chose to show it. We also email you when a gift comes in through your page, including any Gift Aid added to it. You will not see supporters’ email addresses, home addresses or payment details.
Totals and Gift Aid figures on your page, in the creator studio and in our emails to you are for information only. They can change, for example if a gift is refunded, if the supporter’s bank reverses it, or if Gift Aid cannot be claimed on it. Gift Aid figures are estimates until Charities Trust claims that Gift Aid from HMRC.
You can hide a supporter’s name from your page at any time. You cannot reveal a name a supporter kept private.
You must only use what you see about your supporters to run your page and thank your community. Do not try to identify supporters who chose not to show their name, do not contact supporters using anything you learn from Legacy, and do not copy, sell or share supporter information.
The charities on your page
You can choose up to six causes from the charities available on Legacy. Only charities registered with Charities Trust that can currently receive donations can appear on a Care Page.
A charity can ask us to remove it from your page, and we will. The law gives charities the right to stop people fundraising in their name in some circumstances, for example if they do not want to be associated with a particular appeal. We may also remove a cause if the charity closes, stops being eligible, or cannot currently receive donations. When a cause is removed, it disappears from your page, supporters can no longer choose it, and we show this in the creator studio.
Charity names and logos belong to the charities. They appear on your page so supporters know where their money goes. Do not use them anywhere else, or in a way that suggests the charity is involved with you, without its permission.
Your page is public
Care Pages are public. Anyone with the link can see yours, search engines can list it, and your name and photo appear in the preview when someone shares a link to it. Your page shows its totals and recent supporters, with their amounts, unless you switch these off in the creator studio.
What you write, including why each cause matters to you, may reveal things about you, such as your health, religion or political views. Only share what you are happy for anyone to see.
Permission to use your content
You keep ownership of your content. You give us a non-exclusive, royalty-free, worldwide licence to host, store, copy, adapt (for example to fit a theme or make a link preview), display and share your content, so that we can run Share To Care, show your page, and help it reach more supporters, for example by linking to or featuring your page on our website, app and social channels.
We will not use your name, photo or content in Legacy advertising. Linking to or featuring your page as it appears is not advertising.
This licence lasts while your content is on Legacy. When you remove content or your page, we will stop using it within a reasonable time. We may keep a copy where the law requires or allows it, for example to deal with a complaint or legal claim.
You confirm that our use of your content as these terms describe will not infringe anyone’s rights.
Taking your page offline or closing it
You can take your page offline at any time in the creator studio. It stops being public straight away and your draft is kept, so you can send it for review again later.
To remove your Care Page or close your account, email support@givewithlegacy.com. We will take your page down and anonymise it within one month. Records of gifts made through it are kept, because the law requires it.
When we can pause or remove your page
We can take your page offline, remove content from it, or remove it altogether if:
- it breaks these terms or our Terms & Conditions, or we reasonably believe it does;
- a charity on it asks us to;
- we reasonably believe your page, or something you have said or done elsewhere, could harm a charity, your supporters or trust in Legacy;
- we need to for legal or regulatory reasons, or to protect people from harm or fraud; or
- you are no longer eligible to have a Care Page.
Where we can, we will tell you why and give you a chance to put things right first. If you think we got it wrong, you can ask us to look again, as explained under Complaints and appeals. Taking your page offline or removing it does not cancel gifts already made through it. Our Terms & Conditions still apply to them.
Our role
We provide the platform. You are not our employee, agent or partner, and nothing on your page is said by or on behalf of Legacy or the charities.
We aim to keep Share To Care running smoothly, but we cannot promise it will always be available or free of errors. We may change its features, including themes and what the creator studio shows. We will tell you before we make a change that significantly affects your page. If we close Share To Care, we will give you at least 30 days’ notice where we can.
Liability
Share To Care is free. To the extent the law allows, our total liability to you in connection with Share To Care is limited to £50. Nothing in these terms limits any liability that the law does not allow us to limit, including the liability described under Our liability in our Terms & Conditions.
You are responsible for your content and for how you promote your page. If someone makes a claim against us because of your content, or because you broke these terms, you will be responsible for the reasonable losses and costs we suffer as a direct result.
Changes to these terms
We may update these terms. We will give you at least two weeks’ notice by email before a change that affects you takes effect. If you do not agree to it, you can take your page offline and ask us to close it before the change applies.
